TRIAL EXPERIENCE
Mr. Winters has tried to judgment more than seventy-five
cases in State and Federal Court. Among his successful
representations, he acted as chief trial attorney for
Pan American World Airways in the In Re Air Crash at
Bali, Indonesia (a 707 air disaster resulting in over
100 fatalities) at both original trial and re-trial and,
for plaintiff and cross-defendant in the In Re Mid-Air
Collision At San Jose, California (a mid-air collision
resulting in multiple fatalities). In addition, he was
a member of the successful trial team in the In Re Air
India Air Disaster (involving the crash of a 747 in the
Bay of Bombay resulting in more than 200 fatalities)
and Hennessy vs. Piper Aircraft Corporation, (a wrongful
death products liability case).
In more recent years, Mr. Winters has concentrated in
other areas of trial law. He has represented plaintiffs
and defendants in attorney malpractice and breach of
professional responsibility disputes. He is chief Northern
California trial counsel for a Lloyd's of London syndicate
insuring public defenders and district attorneys. Mr.
Winters has been heavily involved in construction defect
and toxic tort litigation representing numerous developers
and general contractors, both as plaintiffs and as defendants.
In his most recent trial, he successfully prosecuted
a claim on behalf of an architect and general contractor,
receiving a verdict in excess of that prayed for and
defeating the claims of cross-complainant landowner.
